Are crypto trading bots legal? What the rules say in the US, the EU and India, where automation crosses a line, taxes on bot trades, and how to stay safe.
Short answer
Yes, in most countries where crypto trading is legal, using a trading bot on your own exchange account is legal too. What matters is how you use it: market manipulation is illegal whoever places the orders, managing other people's money can need a licence, the exchange's API terms apply, and every trade is still taxable.
A trading bot is software that places orders for you. In itself it is not a special legal category: in most places where buying and selling crypto is legal, letting software place those orders on your own account is legal too. The law cares about what is traded, how and for whom, not whether a person or a program clicked the button.
Four questions decide whether a particular use is fine:
US users can generally run bots on their own accounts at exchanges that serve the US, such as Coinbase and Kraken; global exchanges like Binance.com, Bybit and OKX's global platform do not serve US users. Securities and commodities rules and the regulators behind them apply to the markets and assets traded, and anti-manipulation rules apply to everyone.
For tax, the IRS treats digital assets as property. Selling a coin for dollars, or swapping one coin for another, is generally a taxable disposition that produces a capital gain or loss. That includes every trade a bot places on your behalf, so a busy strategy creates many taxable events.
The EU's Markets in Crypto-Assets Regulation (MiCA) requires firms that provide crypto-asset services in the EU, such as exchanges, to be authorised. According to ESMA, the transitional period ended on July 1, 2026, after which unlicensed providers may not serve EU clients. For a trader, the practical point is to use exchanges authorised to serve you, and to keep records for tax, which is set by each member state.
Trading crypto is legal in India, and using automation on your own exchange account is not prohibited. Tax is the part to plan for:
Because TDS applies per transfer, strategies that trade very often feel it more. TradeCorgi agents trade spot only and check the market at most once a minute, which suits steadier strategies. Binance and Bybit are available to TradeCorgi users in India.
Rules range from permissive to outright bans on crypto trading. Before automating, check that crypto trading is allowed where you live, that your exchange is permitted to serve your country, and how trades are taxed. TradeCorgi shows each user only the exchanges available in their country, and re-checks those lists monthly.
A trader in India runs a weekly ETH buy on Binance: $40 every Monday, with a stop rule. Each buy is a transaction on their own account; each later sale is a transfer of a virtual digital asset, subject to TDS at the time and to the flat 30% tax on any income from it. At the end of the year they download the tax-ready export of every trade, with dates, prices and fees, for their tax return. This is an illustrative example, not a real result.
Generally yes, for your own account on an exchange that serves US users, such as Coinbase or Kraken. Manipulative strategies are illegal, and every sale or swap is a taxable event.
Using one on your own account is generally allowed. Under MiCA, the exchanges and other crypto service providers you use must be authorised to serve EU clients.
Crypto trading is legal in India, and using automation on your own exchange account is not prohibited. Income from crypto is taxed at a flat 30%, and 1% TDS applies to many transfers.
Exchanges set their own API terms and rate limits. Using their official API within those terms is how bots are meant to connect; breaking the terms can get a key or account restricted.
Yes. Trades an agent places on your account are your trades, taxed the same as trades you place by hand. Autopilot and Pro include a tax-ready export of every trade.
No. This guide explains the general picture. Rules differ by country and change, so check with a qualified adviser where you live before trading.
